OpenAI announced that it will embed an invisible “text‑grain” watermark in all ChatGPT and Codex output delivered to users in the European Union. The move is a direct response to the EU AI Act’s transparency provisions, which came into force on 2 August and require AI‑generated content to be identifiable by downstream systems.
OpenAI’s blog post explains that the watermark is applied automatically to text generated in the EU, but API customers outside the bloc can choose to opt out. Early tests show the marker can be detected in up to 95 percent of cases when the output is left untouched. However, the company notes that even modest editing erodes the signal: replacing roughly a quarter of the words drops detection to about 17 percent. The finding underscores a broader challenge for provenance tools – they must remain reliable after typical human or automated post‑processing.
The rollout matters because it marks the first large‑scale implementation of EU‑mandated AI provenance by a major provider. By offering a built‑in traceability layer, OpenAI aims to satisfy regulators while giving developers a ready‑made compliance hook. At the same time, the optional opt‑out for non‑EU API users differentiates its approach from rivals such as Anthropic, which have taken a more uniform stance on watermarking.
